Welcome to chessfeed.ai ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using chessfeed.ai, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.

2. User Accounts

Account Creation: To access certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Account Termination: We reserve the right to suspend or terminate your account if you violate these Terms or engage in any conduct that we deem harmful to our Services or other users.

3. Subscription and Billing

Plans: chessfeed.ai offers various subscription plans, including Free, Club, Pro, Elite, Academy, and Enterprise plans. Each plan provides different features and usage limits as described on our Pricing page.

Payment: Paid subscriptions require payment in advance. You authorize us to charge your payment method on a recurring basis according to your selected billing cycle (monthly or yearly).

Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings.

Price Changes: We reserve the right to increase prices for existing subscribers. We will provide at least 30 days' advance written notice of any such price change. The new pricing will automatically apply to your next billing cycle following the notice period. Continued use of the Services after the price change takes effect constitutes your acceptance of the revised pricing.

Payment Failure: If a recurring payment fails for any reason, your account will be immediately downgraded to the Free tier. Access to any premium analysis, coaching sessions, or features generated under your paid plan will be locked behind the paywall until a successful payment is processed and your paid subscription is reinstated. We are not responsible for any loss of access to previously generated content during a period of payment failure.

Taxes: All advertised prices are exclusive of applicable taxes, including but not limited to Goods and Services Tax (GST) or other local taxes. Any applicable taxes will be calculated and added at checkout, and you are solely responsible for their payment.

4. Refund Policy

Our refund policy is detailed in our separate Refund Policy page. Please review it carefully before subscribing.

5. Intellectual Property

Ownership: All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, are the exclusive property of chessfeed.ai or its licensors and are protected by Indian and international copyright, trademark, and other intellectual property laws.

Limited License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes.

6. User Content

Your Content: You retain all rights to the chess games, PGN files, scoresheets, and other content you upload to the Services ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, analyze, and display your User Content solely for the purpose of providing and improving our Services.

Public Content: If you choose to make your games or content public, you grant us the right to display such content on our public game feed and promotional materials.

AI Training Rights: By uploading any chess game or PGN file to chessfeed.ai, you explicitly grant us the right to use that content to train, fine-tune, evaluate, and improve our proprietary AI models and analytical systems, regardless of whether the game is marked as "Public" or "Private." The "Private" designation controls only the visibility of your game on the public-facing game feed and prevents other users from viewing it. "Private" does not restrict our backend systems — including training pipelines, analysis engines, and machine learning infrastructure — from accessing or processing that content. If you do not consent to your games being used for AI training purposes, you should not upload them to the Service.

AI Output Ownership: chessfeed.ai retains full and exclusive intellectual property ownership of all AI-generated text, move annotations, coaching advice, positional assessments, and any other analytical output produced by the platform's AI systems, regardless of the input provided by the user. You are granted a personal, non-exclusive, non-transferable license to view, copy, and use such AI-generated output for your own private, non-commercial purposes. You may not reproduce, republish, sell, license, or otherwise commercialize AI-generated output without our express prior written consent.

Content Standards: You agree not to upload any User Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.

7. Prohibited Uses

You agree not to:

  • Use the Services for any illegal purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Use automated systems (bots, scrapers) to access the Services without our permission
  • Interfere with or disrupt the Services or servers connected to the Services
  • Upload viruses, malware, or any malicious code
  • Violate the intellectual property rights of others
  • Harass, abuse, or harm other users
  • Create multiple accounts to circumvent usage limits

8. Third-Party Services

Our Services integrate with third-party platforms such as Chess.com and Lichess to import your games. Your use of these integrations is subject to the respective third-party terms and conditions. We are not responsible for the availability, accuracy, or content of third-party services.

We use Google OAuth and Microsoft Azure AD for authentication. By using these authentication methods, you agree to their respective terms of service and privacy policies.

Fair Play Enforcement: If a third-party account you have linked to chessfeed.ai (including, but not limited to, a Chess.com or Lichess account) is flagged, restricted, or banned by that platform for fair play violations, engine assistance, or any form of cheating, chessfeed.ai reserves the right to immediately and permanently terminate your chessfeed.ai account without prior notice and without issuing any refund for any unused portion of a paid subscription. This policy exists to maintain the integrity of our platform and community.

9. Fair Usage Policy

Reasonable Use: Where chessfeed.ai describes a feature as "unlimited," this refers to unlimited use by a single human user acting in good faith within the ordinary course of personal chess study. "Unlimited" does not grant permission for programmatic, automated, or bulk use that exceeds the reasonable capacity of a human user.

Prohibited Automated Use: The use of automated scripts, bots, browser automation tools, scrapers, or any non-human mechanism to import games, trigger analysis, or otherwise interact with the Services is strictly prohibited and constitutes a material breach of these Terms.

Soft Usage Limits: To protect our compute infrastructure and ensure consistent service quality for all users, accounts that import or run deep analysis on more than 500 games within a single 24-hour period may be subject to automated rate-limiting, temporary suspension of analysis features, or account suspension at our discretion. If you have a legitimate use case that exceeds these limits, please contact us at ops@chessfeed.ai to discuss an appropriate plan.

10. Age Restrictions

The Services are available to minors; however, where the user is a minor, the legally binding contract is formed with the minor's parent or legal guardian.

If you are under 18, you may only use the Services with the involvement and verifiable consent of a parent or legal guardian. By allowing a minor to use the Services, the parent or guardian agrees to be bound by these Terms and assumes full responsibility for the minor's conduct and any associated charges.

11. Limitation of Liability

No Warranties: The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error-free, or secure.

Chess Analysis Disclaimer: While we strive for accuracy in our chess analysis using Stockfish and AI models, we do not guarantee that all analysis, evaluations, or AI coaching advice will be error-free or optimal. Chess analysis should be used for educational purposes only.

Limitation: To the maximum extent permitted by Indian law, chessfeed.ai and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.

Liability Cap: To the maximum extent permitted by applicable law, chessfeed.ai's maximum aggregate liability for any and all claims arising out of or related to the Services or these Terms shall not exceed the total amount paid by you to chessfeed.ai during the twelve (12) months immediately preceding the event giving rise to the claim.

No SLA Commitment for Standard Plans: For Free, Novice, Student, and Master plans, the Services are provided without any uptime guarantee, service credit commitment, or Service Level Agreement (SLA) obligation.

12. Indemnification

You agree to indemnify, defend, and hold harmless chessfeed.ai and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms.

13. Governing Law and Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Jurisdiction: Any disputes arising out of or related to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India.

Arbitration: We encourage users to contact us first to resolve any disputes informally. If informal resolution is not possible, disputes may be resolved through binding arbitration in accordance with Indian arbitration laws.

14. Academy and Enterprise Plans

Academy and Enterprise plans are governed by separate customized agreements. If you represent an organization, please contact our sales team.

15. Data Protection and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

16. Changes to Services

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

17. Termination

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination, your right to use the Services will immediately cease.

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, we may delete your User Content and account data in accordance with our data retention policies.

Survival: Any provisions of these Terms that by their nature should survive termination shall survive, including without limitation sections relating to Intellectual Property, User Content (AI Training Rights), Limitation of Liability, Indemnification, and Governing Law, and shall remain in full force and effect after any termination or expiration of your account or these Terms.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and chessfeed.ai regarding the use of our Services and supersede all prior agreements and understandings.
